1. Agreement Overview
This Signal Pro Subscriber Agreement ("Subscriber Agreement") is a binding legal contract between you ("Subscriber," "you," or "your") and CNY Signal ("we," "us," or "our") that governs your access to and use of the Signal Pro paid subscription service. This Subscriber Agreement supplements and is incorporated into the CNY Signal Terms of Service and Privacy Policy, which also apply to your use of Signal Pro.
By subscribing to Signal Pro, completing the checkout process, or accessing any Signal Pro feature, you acknowledge that you have read, understand, and agree to be bound by this Subscriber Agreement in its entirety. If you do not agree, do not subscribe.
In the event of a conflict between this Subscriber Agreement and the general Terms of Service, the more specific or restrictive provision shall control with respect to Signal Pro features.
2. Signal Pro Service Description
Signal Pro is a paid subscription tier of CNY Signal that provides access to enhanced features for informational and entertainment purposes only. The following features are included in Signal Pro as of the effective date of this Agreement, subject to change:
- Live Scanner Audio: Streaming audio from unencrypted P25 public safety radio channels covering law enforcement, fire, and EMS dispatches in the Onondaga County, New York area. Audio quality and availability depend on radio reception conditions, hardware status, and frequency coverage.
- AI-Powered Transcriptions: Machine-generated text transcriptions of scanner audio, produced by OpenAI Whisper speech-to-text models. Transcriptions are automated, not human-verified, and subject to significant error rates. See Section 4 for detailed accuracy disclaimers.
- Real-Time Dashboard: A subscriber-only interface displaying active incidents, scanner transcriptions, weather alerts, and traffic information in a consolidated view.
- Community Chat: Access to subscriber chat channels for discussion of local incidents and scanner activity. Chat is moderated and subject to the rules in the general Terms of Service.
- SMS Alerts: Automated text message notifications of significant incidents, delivered to the phone number on your account. SMS delivery depends on carrier networks, system availability, and alert thresholds. Message frequency varies.
- Incident Map: An interactive map displaying approximate locations of reported incidents. All map markers represent estimated locations only and are not precise addresses.
- Camera Feeds: Access to publicly available traffic and weather camera feeds from public sources, including NYSDOT. Camera availability and image freshness are controlled by the source agencies, not by CNY Signal.
Feature Availability: CNY Signal reserves the right to modify, suspend, add, or remove any Signal Pro feature at any time without prior notice. No specific feature is guaranteed to be available at any given time. A paid subscription provides access to premium features on an "as available" basis.
Coverage Area: Signal Pro coverage is limited to the geographic areas served by the radio frequencies and data sources we monitor. Coverage is concentrated in Onondaga County and surrounding areas but is not comprehensive. There are gaps in frequency coverage, geographic reach, and incident type monitoring. Signal Pro does not provide comprehensive public safety monitoring for any jurisdiction.
3. Critical Notice: Not an Emergency Service
SIGNAL PRO IS NOT AN EMERGENCY SERVICE, AN EMERGENCY NOTIFICATION SYSTEM, A LIFE-SAFETY TOOL, OR A SUBSTITUTE FOR 911.
Signal Pro is an informational and entertainment subscription. It is not designed, intended, or suitable for use as a safety resource. You must NEVER:
- Rely on Signal Pro to determine whether an emergency is occurring in your area
- Use Signal Pro as a basis for deciding whether to call 911
- Delay contacting emergency services because of information you did or did not see on Signal Pro
- Use Signal Pro to make evacuation, shelter-in-place, or protective action decisions
- Treat the absence of information on Signal Pro as an indication that an area is safe
- Navigate toward any incident scene based on information from Signal Pro
- Treat Signal Pro transcriptions or alerts as an accurate or complete record of emergency activity
IF YOU ARE IN DANGER OR NEED EMERGENCY HELP, CALL 911 IMMEDIATELY. CNY Signal cannot dispatch help, contact emergency services on your behalf, or provide any form of emergency assistance.
4. AI Transcription Accuracy Disclaimer
Signal Pro's scanner transcription feature uses OpenAI Whisper, a machine learning speech-to-text model, to convert radio audio into text. This is an automated process with no human verification in real time. By subscribing, you acknowledge and accept the following limitations:
4.1 Known Error Categories
- Name errors: The AI may mishear, misspell, fabricate, or incorrectly transcribe the names of individuals, officers, suspects, callers, streets, landmarks, businesses, or locations. A name appearing in a transcription does not mean that person was mentioned on the radio.
- Address errors: Street addresses, cross-streets, and location descriptions may be transcribed incorrectly. The AI may substitute similar-sounding street names, invent addresses that do not exist, or place incidents in the wrong municipality.
- Unit and code errors: Patrol unit numbers, radio codes, signal codes, and dispatch terminology may be incorrectly transcribed. The AI was not trained on local Onondaga County radio conventions.
- Hallucination: AI models are known to "hallucinate," meaning they may fabricate words, phrases, sentences, or entire statements that were not present in the original audio. This is a documented characteristic of speech-to-text AI, not a malfunction.
- Speaker misattribution: The AI may attribute statements to the wrong speaker or fail to distinguish between different voices on the same channel.
- Omissions: The AI may fail to transcribe portions of audio due to background noise, signal interference, overlapping transmissions, low audio quality, or radio static. Silence or gaps in transcription do not mean silence on the radio.
4.2 Environmental Factors
Transcription accuracy is further degraded by conditions inherent to public safety radio communications:
- Background noise from sirens, wind, traffic, and emergency scenes
- Radio signal interference, multipath distortion, and weak signals
- Overlapping transmissions from multiple units on the same frequency
- Specialized law enforcement, fire, and EMS jargon not in the AI model's training data
- Rapid speech, emotional delivery, and non-standard pronunciation common during high-stress incidents
4.3 Subscriber Acknowledgment
By using Signal Pro transcription features, you acknowledge and agree that:
- Transcriptions are approximate, error-prone representations of audio content, not accurate records
- You will not treat transcriptions as factual statements about any individual, location, or incident
- You will not share, republish, or redistribute transcriptions as if they were verified information
- You will not take any action based on transcription content without independent verification through official sources
- CNY Signal bears no liability for errors, fabrications, or omissions in AI-generated transcriptions
5. Scanner Data & Radio Content
Signal Pro provides access to live audio streams from unencrypted P25 public safety radio channels. You acknowledge and agree that:
- Preliminary information: All scanner data reflects initial dispatch reports and field communications. These are preliminary, unverified, and frequently change. Suspects may be cleared, locations may be corrected, and incident classifications may be revised. Initial reports must not be treated as established facts.
- Data delay: There is an inherent delay between real-world events and their appearance on the platform due to radio processing, transcription, and display pipeline latency. Information displayed on Signal Pro is never truly "real-time" and should not be treated as such for any time-sensitive purpose.
- Coverage gaps: Signal Pro does not monitor all public safety radio frequencies, all agencies, or all geographic areas. The absence of information about a particular incident, location, or agency does not mean nothing is happening. Coverage is limited by hardware, antenna placement, frequency programming, and radio propagation conditions.
- Audio quality: Live scanner audio may be garbled, distorted, interrupted, or unintelligible. Audio quality varies with atmospheric conditions, distance from transmission sources, and radio equipment status. Audio streams may cut out without warning.
- No obligation to publish: CNY Signal retains sole discretion over what scanner content to publish, display, or suppress. Certain call types and sensitive information are deliberately suppressed in accordance with our editorial policies.
6. Service Availability & Limitations
CNY Signal does not guarantee that Signal Pro will be available at any particular time or that any feature will function without interruption or error. Scanner audio, transcriptions, alerts, dashboard, chat, map, and camera features may be unavailable, delayed, or degraded at any time due to:
- Radio reception conditions, hardware failures, SDR equipment outages, or antenna issues
- Internet connectivity disruptions at any point in the delivery chain
- Server outages, container failures, or database unavailability
- Scheduled or emergency maintenance
- Third-party service provider outages (Twilio, Paddle, cloud infrastructure)
- Severe weather, power outages, or natural disasters affecting infrastructure
- Software bugs, processing errors, or system overload conditions
Your subscription fee provides access to premium features on an "as available" basis. Service interruptions, outages, or degraded performance do not entitle you to a refund, credit, or extension of your subscription period.
7. Assumption of Risk
By subscribing to Signal Pro, you expressly acknowledge that you access and use the service entirely at your own risk. You voluntarily assume all risks associated with:
- Accessing, viewing, listening to, or relying on scanner audio, transcriptions, alerts, or any other Signal Pro content
- The possibility that information may be inaccurate, incomplete, delayed, fabricated by AI, or wholly incorrect
- The possibility that AI transcriptions may misidentify individuals, locations, or circumstances
- Emotional distress from exposure to public safety incident content, including descriptions of violence, injury, death, and emergencies
- The possibility that the service may be unavailable when you need or want to access it
- Any action you take or fail to take based on information obtained through Signal Pro
You agree that you will independently verify all information obtained from Signal Pro through official sources (911, law enforcement, National Weather Service, local government) before taking any action based on such information.
8. Subscriber Obligations
As a Signal Pro subscriber, you agree to the following obligations:
8.1 Prohibited Uses of Signal Pro Content
- No commercial republication: You may not republish, redistribute, resell, license, or commercially exploit Signal Pro content, including scanner audio, transcriptions, or alert data, without prior written authorization from CNY Signal. Brief quotations for non-commercial, personal social media discussion are permitted provided you attribute the source to CNY Signal.
- No interference with emergency operations: You may not use information obtained through Signal Pro to navigate to, respond to, interfere with, obstruct, or in any way involve yourself in any active emergency, crime scene, fire scene, accident, or law enforcement operation.
- No harassment or contact: You may not use information from Signal Pro to identify, locate, contact, harass, threaten, stalk, or communicate with any individual mentioned in scanner traffic, transcriptions, or alerts, including but not limited to victims, suspects, witnesses, callers, patients, or responding personnel.
- No PII republication: If any personally identifiable information (names, addresses, phone numbers) appears in Signal Pro content despite our automated redaction systems, you may not republish, share, or further disseminate that information. You agree to report any such instances to [email protected].
8.2 Account Security
- You are responsible for maintaining the security of your account credentials and OTP access
- You may not share your Signal Pro login, OTP codes, or subscription access with others
- You agree to notify us promptly of any unauthorized access to your account
- Signal Pro subscriptions are for individual, personal, non-commercial use only unless you have an Enterprise subscription
8.3 Reporting Inaccuracies
If you identify information in Signal Pro content that you believe to be inaccurate, harmful, or containing personally identifiable information that should be removed, you are encouraged to report it to [email protected]. We will review all reports and take appropriate action.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CNY SIGNAL AND ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS (COLLECTIVELY, "CNY SIGNAL PARTIES") SHALL NOT BE LIABLE TO ANY SUBSCRIBER OR THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO YOUR USE OF SIGNAL PRO, INCLUDING BUT NOT LIMITED TO:
- Personal injury, bodily harm, or death
- Property damage or loss
- Emotional distress, mental anguish, or psychological harm from exposure to incident content
- Any action taken or not taken in reliance on Signal Pro content, transcriptions, alerts, or audio
- Errors, inaccuracies, fabrications, or omissions in AI-generated transcriptions or summaries
- Failure to receive or delay in receiving alerts or notifications
- Service interruptions, outages, or degraded performance
- Misidentification of individuals, locations, or incidents in transcriptions or alerts
- Loss of revenue, profits, data, or business opportunity
- Reputational harm resulting from information displayed on the Service
AGGREGATE LIABILITY CAP: The total aggregate liability of all CNY Signal Parties to you for all claims arising out of or related to Signal Pro shall not exceed the total subscription fees you actually paid to CNY Signal in the twelve (12) months immediately preceding the event giving rise to the claim. In no event shall this amount exceed one hundred U.S. dollars ($100.00).
This limitation applies regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise), even if a CNY Signal Party has been advised of or should have known of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless all CNY Signal Parties from and against any and all claims, suits, actions, proceedings, losses, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of Signal Pro, including any content you access, listen to, view, or share
- Your violation of this Subscriber Agreement, the Terms of Service, or any applicable law
- Any action you take or fail to take based on information obtained through Signal Pro
- Your use or misuse of scanner data, transcriptions, audio, or alert content
- Content you post in Signal Pro community chat or other interactive features
- Any claim by a third party arising from your use of Signal Pro
- Your sharing, republishing, or redistribution of Signal Pro content in violation of this Agreement
11. Subscription & Billing Terms
11.1 Plans and Pricing
Signal Pro is available at the following subscription rates as of the effective date of this Agreement:
- Signal Pro: $7.99 per month
- Enterprise: $29.99 per month
Pricing is subject to change. You will be notified at least 30 days before any price increase takes effect for your active subscription.
11.2 Merchant of Record
All subscription payments are processed by Paddle (Paddle.com Market Limited), which acts as the Merchant of Record. Paddle processes your payment, collects applicable taxes, and issues receipts and invoices. CNY Signal does not directly collect, process, or store your credit card number, debit card number, or bank account information. By subscribing, you also agree to Paddle's Terms of Service and Paddle's Privacy Policy.
11.3 Auto-Renewal
Your subscription will automatically renew at the end of each billing period at the then-current rate. You will be charged for each renewal period unless you cancel before the renewal date. This is a recurring charge. It is your responsibility to cancel if you do not wish to continue.
11.4 Cancellation
You may cancel your Signal Pro subscription at any time through any of the following methods:
- Your account settings on the CNY Signal dashboard at cnysignal.com
- Email to [email protected]
- Paddle's subscription management portal
Cancellation takes effect at the end of your current billing period. You will retain access to Signal Pro features until the end of the period for which you have already paid. There are no cancellation fees, penalties, or charges of any kind.
11.5 Refunds
Subscription fees are generally non-refundable. If you believe you were charged in error, contact [email protected] within 30 days of the charge. Refund requests are processed through Paddle in accordance with Paddle's refund policies and applicable consumer protection law. CNY Signal may, at its sole discretion, issue a refund or credit in exceptional circumstances.
11.6 Taxes
Subscription prices may be subject to applicable sales tax, VAT, or other taxes as determined by your jurisdiction. Paddle calculates and collects applicable taxes at checkout. The displayed subscription price may not include taxes, which will be shown at checkout.
These subscription disclosures are provided in compliance with the FTC Negative Option Rule (16 CFR Part 425), the FTC Click-to-Cancel Rule, and New York General Business Law § 527-a.
12. Data Collection & Privacy
This section summarizes data practices specific to Signal Pro subscribers. For complete details, see our Privacy Policy.
12.1 What Data We Collect from Subscribers
- Phone number: Required for OTP authentication and SMS alert delivery. Stored in our subscriber database.
- Email address: Collected if provided. Used for account communications and billing notifications (via Paddle).
- Location data: Street address, ZIP code, and/or coordinates, provided by you for proximity-based alert targeting. Used solely to determine which incidents are relevant to your alert zone. Location data is not shared with third parties for marketing or any non-operational purpose.
- Display name: Optional. Used for your subscriber profile and chat identity.
- Chat messages: Messages posted in community chat are stored on our servers and associated with your subscriber profile.
- Usage data: Pages visited, features used, session duration, and interaction patterns within the dashboard.
12.2 Payment Data
Paddle, as Merchant of Record, collects and processes your payment information directly. CNY Signal receives a transaction record (subscription ID, plan, status, email) from Paddle but does not receive, process, or store your full credit card number, debit card number, CVV, or bank account details.
12.3 Scanner Transcription Data
Raw AI transcription data (the direct output of the Whisper model) is retained for up to 30 days for quality assurance, error correction, and system improvement purposes, after which it is automatically purged. Processed and redacted transcription summaries (the content displayed on the dashboard) may be retained longer as part of the incident history archive.
12.4 NY SHIELD Act Compliance
CNY Signal maintains reasonable administrative, technical, and physical safeguards to protect subscriber private information in compliance with the New York Stop Hacks and Improve Electronic Data Security Act (SHIELD Act), NY General Business Law § 899-aa and § 899-bb. These safeguards include:
- HTTPS encryption for all data in transit
- Encrypted database connections (TLS) for data at rest
- Role-based access controls limiting personnel access to subscriber data
- Regular security reviews and vulnerability assessments
- Incident response procedures for security breaches
In the event of a data breach involving subscriber private information, CNY Signal will notify affected New York residents in the most expedient time possible and without unreasonable delay, as required by the SHIELD Act.
12.5 Data Deletion
You may request deletion of your subscriber data at any time by contacting [email protected]. Upon account deletion, we will remove your personal information within 30 days, except for records we are required to retain for legal compliance (e.g., TCPA consent records retained for 5 years, billing records retained per tax requirements).
13. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
All disputes arising out of or related to this Subscriber Agreement or your use of Signal Pro are subject to the binding arbitration and class action waiver provisions in Section 21 of the CNY Signal Terms of Service, which are incorporated here by reference.
To summarize: disputes will be resolved by binding individual arbitration administered by the American Arbitration Association in Onondaga County, New York. You waive your right to participate in a class action, collective action, or representative proceeding. You may opt out of arbitration within 30 days of first subscribing by notifying [email protected] in writing.
14. Age Requirements
You must be at least 13 years of age to create a CNY Signal account. You must be at least 18 years of age to subscribe to Signal Pro. By subscribing, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this Agreement.
CNY Signal does not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501-6506. If we become aware that a subscriber is under 13, we will terminate the account and delete associated personal information.
The Service contains content related to public safety incidents that may include descriptions of violence, injury, death, and emergencies. Parents and guardians should consider whether this content is appropriate for minors in their household.
15. Governing Law
This Subscriber Agreement is governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-laws principles. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in Onondaga County, New York.
16. Termination
16.1 Termination by You
You may cancel your Signal Pro subscription at any time as described in Section 11.4. Cancellation takes effect at the end of your current billing period.
16.2 Termination by CNY Signal
CNY Signal may suspend or terminate your Signal Pro access immediately, without prior notice or refund, if:
- You violate this Subscriber Agreement, the Terms of Service, or any applicable law
- You use Signal Pro content to interfere with emergency operations or harass individuals
- You share your account credentials or subscription access with unauthorized users
- You engage in scraping, systematic data collection, or unauthorized API access
- Your payment method fails and is not resolved within a reasonable period
- CNY Signal discontinues the Signal Pro service
16.3 Effect of Termination
Upon termination, your access to Signal Pro features will cease. Sections of this Agreement that by their nature should survive termination (including liability limitations, indemnification, arbitration, and governing law) shall survive.
17. General Provisions
17.1 Entire Agreement
This Subscriber Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and CNY Signal with respect to Signal Pro.
17.2 Severability
If any provision of this Agreement is found invalid or unenforceable, it shall be modified to the minimum extent necessary. The remaining provisions shall continue in full force and effect.
17.3 Waiver
The failure of CNY Signal to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer this Agreement or your subscription without CNY Signal's prior written consent. CNY Signal may assign its rights and obligations under this Agreement without restriction.
17.5 Force Majeure
CNY Signal shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, severe weather, power outages, equipment failures, radio interference, government actions, or third-party service failures.
17.6 Notices
CNY Signal may provide notices to you via the email or phone number on your account, or by prominent posting on the Service. You may provide notices to CNY Signal via the contact methods listed below.
