1. Acceptance of Terms

By accessing, browsing, or using CNY Signal (the "Service"), available at cnysignal.com and any associated mobile applications, APIs, or feeds, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms incorporated by reference, including the Signal Pro Subscriber Agreement if you subscribe to a paid plan. If you do not agree to these Terms in their entirety, you must immediately discontinue all use of the Service.

Your continued use of the Service following the posting of any changes to these Terms constitutes your acceptance of those changes. We recommend reviewing these Terms periodically.

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

CNY Signal is an independent, automated public awareness aggregation service that collects, structures, and displays publicly available information concerning public safety incidents, weather events, road conditions, and utility outages in Central New York (the "Syracuse metropolitan area"). The Service includes real-time incident alerts, radio scanner audio streams, AI-assisted transcriptions of radio communications, newsroom articles, weather data, traffic information, community chat, and subscriber notification services.

CNY Signal is provided solely for general informational and entertainment purposes. CNY Signal is:

• NOT a news organization under any applicable licensing or regulatory framework
• NOT affiliated with, endorsed by, or connected to any governmental entity, law enforcement agency, fire department, EMS service, 911 center, or emergency management organization
• NOT a substitute for official emergency communications, alerts, or notifications
• NOT staffed by licensed emergency services personnel

3. Entertainment & Informational Purpose Only

ALL content published on CNY Signal is provided for informational and entertainment purposes only. This includes, without limitation: incident alerts, weather summaries, newsroom articles, scanner audio streams, AI-generated transcriptions, map locations, community chat messages, and any other content or data displayed on the Service.

No content on CNY Signal constitutes professional advice, emergency guidance, safety instruction, legal counsel, medical recommendation, or actionable direction of any kind. Users acknowledge and agree that:

• Information may be delayed, inaccurate, incomplete, outdated, or wholly incorrect
• Content must not be relied upon for any life-safety, legal, medical, financial, or emergency decision
• Some content is generated, transcribed, or assisted by artificial intelligence and may contain significant errors, hallucinations, or fabrications
• Map locations are approximate estimates only and are not precise addresses
• Scanner audio streams may contain garbled, overlapping, or unintelligible transmissions
• Initial incident reports frequently differ from final outcomes and verified facts
• The Service does not provide comprehensive or complete coverage of any geographic area, incident type, or time period
• Absence of information on the Service does not mean an incident has not occurred

You expressly acknowledge and agree that your use of the Service is entirely at your own risk. You voluntarily assume all risks associated with accessing, viewing, listening to, or relying on any information, content, audio, data, or materials provided through the Service, including but not limited to:

• The risk that information may be inaccurate, incomplete, delayed, or fabricated by AI systems
• The risk that AI transcriptions of radio communications may contain errors, misidentifications, incorrect locations, or fabricated content
• The risk that scanner audio may be garbled, misleading, or taken out of context
• The risk that incident information may identify locations, individuals, or circumstances incorrectly
• The risk of emotional distress from exposure to public safety incident content
• The risk that the Service may be unavailable, interrupted, or degraded at any time without notice

You agree that you will independently verify all information obtained from the Service through official sources before taking any action based on such information.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. CNY SIGNAL AND ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, "CNY SIGNAL PARTIES") EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES THAT THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WARRANTIES AS TO THE ACCURACY, COMPLETENESS, TIMELINESS, CURRENCY, RELIABILITY, QUALITY, OR SUITABILITY OF ANY INFORMATION, CONTENT, AUDIO, TRANSCRIPTION, OR DATA
• WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
• WARRANTIES THAT AI-GENERATED OR AI-TRANSCRIBED CONTENT WILL BE ACCURATE OR FREE FROM HALLUCINATIONS OR FABRICATIONS
• WARRANTIES THAT RADIO SCANNER AUDIO WILL BE CONTINUOUS, COMPLETE, OR INTELLIGIBLE
• WARRANTIES THAT INFORMATION WILL BE DELIVERED IN A TIMELY MANNER OR AT ALL

No advice or information, whether oral or written, obtained from the Service shall create any warranty not expressly stated in these Terms.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANY CNY SIGNAL PARTY BE LIABLE TO ANY USER, SUBSCRIBER, OR THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR:

• Personal injury, bodily harm, or wrongful death
• Property damage or loss
• Loss of revenue, profits, data, goodwill, or business opportunity
• Emotional distress, mental anguish, or reputational harm
• Any action taken or not taken in reliance on information published on or omitted from the Service
• Failure to receive alerts, notifications, or information
• Errors in AI-generated transcriptions, summaries, or content
• Service interruptions, outages, or degraded performance
• Unauthorized access to or alteration of your data or transmissions

This limitation applies regardless of the legal theory asserted (including contract, tort, negligence, strict liability, or any other theory), even if any CNY Signal Party has been advised of or should have known of the possibility of such damages.

THE AGGREGATE LIABILITY OF ALL CNY SIGNAL PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO CNY SIGNAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS ($10.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of the CNY Signal Parties shall be limited to the fullest extent permitted by applicable law.

8. Indemnification

You agree to defend, indemnify, and hold harmless all CNY Signal Parties from and against any and all claims, suits, actions, proceedings, losses, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees and litigation costs) arising out of or related to:

• Your access to or use of the Service
• Your violation of these Terms or any applicable law, regulation, or third-party right
• Any action you take or fail to take in reliance on information obtained from the Service
• Your User Content or any content you submit, post, or transmit through the Service
• Your use of scanner data, transcriptions, or audio for any purpose
• Any claim by a third party arising from your use of or reliance on the Service

CNY Signal reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

9. Accuracy & Completeness of Information

CNY Signal aggregates information from automated public third-party data sources that it does not control, independently verify, or confirm. These sources include, without limitation: unencrypted public safety radio communications, government data feeds (including Onondaga County CAD), National Weather Service data, 511NY traffic data, and publicly available records.

All information displayed on the Service may be delayed, inaccurate, incomplete, outdated, or wholly incorrect. CNY Signal expressly disclaims any obligation to verify, correct, update, or maintain the accuracy of any information in real time or at any other interval.

Users acknowledge that:

• Public safety data is inherently time-sensitive and subject to rapid change
• Publication of incident data does not constitute confirmation that an event occurred as described
• Initial reports frequently differ from final verified outcomes
• Scanner-sourced data undergoes automated processing that may introduce errors
• The Service does not represent that it monitors all frequencies, agencies, or incident types

10. AI-Generated & AI-Transcribed Content

CNY Signal uses artificial intelligence tools, including but not limited to OpenAI language models and OpenAI Whisper speech-to-text models, to assist with:

• Radio transcription: Automated speech-to-text conversion of public safety radio communications using AI models. These transcriptions are machine-generated and are NOT human-verified in real time.
• Content generation: AI-assisted research, drafting, and editing of newsroom articles and content summaries.
• Data processing: Automated categorization, summarization, and structuring of incident data.

AI transcription limitations: AI speech-to-text models (including Whisper) have documented error rates and limitations that are particularly pronounced when processing radio communications. Users must be aware that:

• Transcriptions may contain significant errors in names, addresses, unit numbers, and incident descriptions
• AI models may "hallucinate" or fabricate words, phrases, or entire sentences that were not present in the original audio
• Background noise, signal interference, overlapping transmissions, and radio-specific jargon increase error rates substantially
• Transcription confidence scores are estimates only and do not guarantee accuracy at any level
• A transcription rated as "high confidence" may still contain material errors
• AI models may misattribute statements to incorrect speakers or units
• Street names, landmarks, and geographic references may be incorrectly transcribed due to the model's training data not including local Central New York geography

AI-generated content is processed through editorial pipelines but may contain errors, inaccuracies, fabrications, or AI-generated artifacts. Users acknowledge that:

• AI-assisted articles are not traditional human-reported journalism
• AI may produce factual errors, outdated information, mischaracterizations, or fabricated sources
• AI-generated content is provided for informational and entertainment purposes only
• CNY Signal assumes no liability for decisions made based on AI-assisted or AI-transcribed content
• Users should never treat AI-transcribed content as an accurate record of radio communications

11. Radio Scanner & Public Safety Data

Incident data displayed on the Service is sourced from unencrypted public safety radio communications, government data feeds, and other publicly available sources. CNY Signal does not monitor, intercept, or decode encrypted, scrambled, or otherwise secured communications.

All radio-sourced data undergoes automated processing, including AI transcription and automated redaction designed to remove personally identifiable information before publication. Sensitive categories (including but not limited to juvenile records, mental health crisis calls, sexual assault reports, and domestic violence victim information) are suppressed in accordance with our internal publishing policies and applicable law, including New York Civil Rights Law Section 50-b.

Location data derived from radio communications is generalized to the municipality, neighborhood, or block level. Exact residential addresses of victims, patients, or callers are not intentionally published.

Despite these safeguards, radio-sourced data may contain errors, residual personally identifiable information, or inaccuracies introduced during transmission, reception, transcription, or automated processing. Users must not use radio-sourced data to navigate to, identify individuals at, interfere with, or respond to any incident scene.

12. Scanner Content Legal Notice

The reception and publication of unencrypted public safety radio transmissions is lawful under federal law. The Electronic Communications Privacy Act (18 U.S.C. § 2510-2522) exempts from its interception prohibition radio communications that are "readily accessible to the general public" (18 U.S.C. § 2511(2)(g)(i)). Section 605 of the Communications Act (47 U.S.C. § 605) applies to common carrier communications and does not prohibit reception of public safety radio broadcasts.

New York State has no statute prohibiting the monitoring of unencrypted public safety radio communications. New York's eavesdropping statutes (Penal Law § 250.00-250.10) apply to wiretapping and mechanical overhearing of private conversations, not to passive reception of signals broadcast over public airwaves.

The publication of lawfully obtained information about matters of public concern is protected by the First Amendment to the United States Constitution.

CNY Signal does not intercept, decode, decrypt, or access any encrypted, scrambled, trunked-encrypted, or otherwise secured communications. All monitored communications are unencrypted transmissions receivable by any person with commercially available radio equipment.

13. Subscriptions, Billing & Auto-Renewal

CNY Signal offers paid subscription plans ("Signal Pro" at $7.99 per month and "Enterprise" at $29.99 per month) that provide access to premium features, including but not limited to: live scanner audio streams, real-time dashboard, AI-powered transcriptions, community chat, SMS alerts, incident map, and camera feeds. Current plans and pricing are displayed at the time of purchase. Signal Pro subscribers are additionally governed by the Signal Pro Subscriber Agreement.

Subscription billing is processed by our third-party payment processor, Paddle (Paddle.com Market Limited). Paddle acts as the Merchant of Record for all subscription transactions. By subscribing, you also agree to Paddle's Terms of Service and Paddle's Privacy Policy.

By subscribing to a paid plan, you agree to the following:

• Recurring billing: Paid subscriptions are billed on a recurring basis (monthly or annually, as selected) at the rate displayed at the time of purchase. Your payment method will be automatically charged each billing cycle until you cancel.
• Auto-renewal: Your subscription will automatically renew at the end of each billing period at the then-current rate. You will be charged for each renewal period unless you cancel before the renewal date.
• How to cancel: You may cancel your subscription at any time through your account settings at cnysignal.com, by contacting us at [email protected], or through Paddle's subscription management portal. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period for which you have already paid.
• No cancellation fees: There are no penalties, fees, or charges for canceling your subscription at any time.
• Refunds: Subscription fees are generally non-refundable. If you believe you were charged in error, contact [email protected] within 30 days of the charge. Refund requests are handled through Paddle in accordance with Paddle's refund policies and applicable law.
• Price changes: CNY Signal reserves the right to change subscription pricing. You will be notified at least 30 days before any price increase takes effect for your subscription. If you do not cancel before the new price takes effect, continued use constitutes acceptance of the new rate.
• Free trials: If a free trial is offered, you will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will be charged the applicable subscription fee and your subscription will auto-renew thereafter.
• Taxes: Subscription prices may be subject to applicable sales tax, VAT, or other taxes as determined by your jurisdiction. Paddle calculates and collects applicable taxes at checkout.

This disclosure is provided in compliance with the FTC Negative Option Rule (16 CFR Part 425), the FTC Click-to-Cancel Rule, and New York General Business Law § 527-a governing automatic renewal offers and continuous service offers.

No guarantee of service: A paid subscription does not guarantee uninterrupted access to any feature, continuous scanner audio availability, delivery of any specific number of alerts, or any particular level of service quality. Scanner audio streams depend on radio reception conditions, hardware availability, and other factors outside CNY Signal's control.

14. SMS Alert Service Terms

By subscribing to CNY Signal SMS alerts, you acknowledge and agree:

• You consent to receive recurring automated text messages at the phone number you provide
• Message frequency varies (typically 2–15 messages per day; may increase during emergencies or active weather events)
• Standard message and data rates apply; contact your carrier for details
• You may opt out at any time by replying STOP to any message
• Reply HELP for assistance
• Consent to receive SMS messages is not a condition of any purchase
• You must be 18 years or older to subscribe to SMS alerts
• SMS alerts may be delayed, incomplete, or fail to deliver due to carrier network conditions, system outages, or other factors
• SMS alerts are for informational and entertainment purposes only and must not be relied upon for emergency decisions

CNY Signal complies with the Telephone Consumer Protection Act (47 U.S.C. § 227) and maintains timestamped consent records for all subscribers. For complete data handling practices, see our Privacy Policy.

15. User-Generated Content & Chat

CNY Signal may offer community chat, comment, tip submission, or other user interaction features ("User Content"). By posting User Content, you agree that:

• You are solely responsible for the content of your messages, submissions, and interactions
• You will not post threats, defamation, harassment, hate speech, doxxing, or any content that violates applicable law
• You will not post personally identifiable information of any individual (including names, addresses, phone numbers, or photographs) derived from scanner data, transcriptions, or any other source
• You will not post false reports, fabricated incidents, or deliberately misleading information
• CNY Signal may moderate, edit, or remove any User Content at its sole discretion and without prior notice or liability
• CNY Signal may suspend or permanently terminate your access for violations of these rules
• You grant CNY Signal a non-exclusive, royalty-free, perpetual, worldwide license to display, reproduce, and distribute your User Content in connection with the Service
• CNY Signal is not liable for any User Content posted by third parties
• CNY Signal is not required to monitor User Content but reserves the right to do so

CNY Signal does not endorse, verify, or assume responsibility for any User Content. Interaction with other users is at your own risk.

16. Prohibited Conduct

You agree that you will NOT use the Service to:

• Harass, stalk, threaten, intimidate, or harm any individual or group
• Navigate to, congregate at, or in any way interfere with any active emergency, crime, or incident scene
• Impersonate any emergency services agency, officer, or personnel
• Identify or attempt to identify individuals mentioned in scanner communications, transcriptions, or alerts
• Republish unredacted personally identifiable information obtained through the Service
• Scrape, harvest, crawl, or systematically collect data from the Service without prior written authorization
• Access or attempt to access the Service's API, backend systems, or data stores without authorization
• Introduce malicious code, viruses, or conduct denial-of-service attacks
• Reproduce, redistribute, resell, or commercially exploit Service content without written authorization
• Circumvent, disable, or interfere with security-related features of the Service
• Use the Service in any manner that violates applicable local, state, federal, or international law
• Use information from the Service to commit, facilitate, or plan any illegal act

Violation of this section may result in immediate termination of your account, referral to law enforcement, and pursuit of all available legal remedies.

17. Intellectual Property

All original content, visual design, software, code, logos, trademarks, and branding on CNY Signal (excluding underlying public data and User Content) is the exclusive intellectual property of CNY Signal and its licensors. No portion may be copied, reproduced, modified, distributed, displayed, or exploited without prior written consent. All rights not expressly granted are reserved.

The CNY Signal name, logo, and "Signal Pro" are trademarks of CNY Signal. You may not use these marks without prior written permission.

18. DMCA & Copyright Complaints

CNY Signal respects the intellectual property rights of others. If you believe that content on the Service infringes your copyright, please send a notice containing the following information to our designated DMCA agent:

• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing, with sufficient information to locate it on the Service
• Your contact information (name, address, phone number, email)
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• Your physical or electronic signature

Upon receipt of a valid DMCA notice, CNY Signal will expeditiously remove or disable access to the allegedly infringing material and notify the user who posted it. If the user believes the removal was in error, they may file a counter-notification in accordance with 17 U.S.C. § 512(g).

19. Third-Party Links & Services

The Service may contain links to third-party websites, embed content from external providers, or integrate with third-party services (including Paddle for billing, Twilio for SMS, and various data providers). CNY Signal has no control over, and assumes no responsibility for, the content, privacy practices, terms, availability, or security of any third-party site or service. Inclusion of any link or integration does not constitute endorsement.

20. Children's Privacy (COPPA Compliance)

The Service is not directed to, and is not intended for use by, children under the age of 13. CNY Signal does not knowingly collect, use, or disclose personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501-6506.

If we become aware that we have inadvertently collected personal information from a child under 13, we will take steps to delete such information as promptly as possible. If you believe a child under 13 has provided us with personal information, please contact us immediately at [email protected].

Users under 18 should use the Service only with the involvement and consent of a parent or legal guardian. The Service contains content related to public safety incidents that may include descriptions of violence, injury, and death that may not be appropriate for minors.

21. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

21.1 Agreement to Arbitrate

You and CNY Signal agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship between you and CNY Signal (collectively, "Disputes") shall be resolved exclusively through binding individual arbitration, except as set forth below. This agreement to arbitrate is intended to be broadly interpreted.

21.2 Arbitration Rules & Forum

Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this section. The arbitration shall be conducted by a single arbitrator. The arbitration shall take place in Onondaga County, New York, unless you and CNY Signal agree to an alternative location or to conduct the proceeding via telephone, video conference, or written submissions.

21.3 Arbitration Fees

If you initiate arbitration, CNY Signal will reimburse your filing fee up to $200. Each party shall bear its own attorneys' fees unless the arbitrator determines that a claim was frivolous, in which case the arbitrator may award fees to the prevailing party.

21.4 Opt-Out

You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to [email protected] within 30 days of first accepting these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, the Governing Law and Jurisdiction provisions in Section 22 shall apply.

21.5 Class Action Waiver

YOU AND CNY SIGNAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

21.6 Exceptions

Notwithstanding the above: (a) either party may bring an individual action in small claims court in Onondaga County, New York, for claims within that court's jurisdiction; (b) either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights; and (c) claims related to the enforceability of the class action waiver are for the courts, not an arbitrator, to decide.

21.7 Survival

This arbitration agreement shall survive termination of these Terms and your use of the Service.

22. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-laws principles. For any Dispute not subject to arbitration, you irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in Onondaga County, New York.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL IN ANY ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

23. Force Majeure

CNY Signal shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, severe weather, power outages, internet service disruptions, equipment failures, radio frequency interference, acts of terrorism, government actions, pandemics, labor disputes, or third-party service provider failures. During any such event, CNY Signal's obligations shall be suspended for the duration of the force majeure condition.

24. Changes to Terms

CNY Signal reserves the right to modify these Terms at any time. Changes become effective upon posting to the Service. We will make reasonable efforts to notify subscribers of material changes (such as by email or prominent website notice), but it is your responsibility to review these Terms periodically. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

25. Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent. If such modification is not possible, the provision shall be severed. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

26. Entire Agreement
